Introduction

Welcome to MrWalls Drywall & Painting. These Terms and Conditions ("Terms") govern your use of our website and the services we provide, including drywall repair, plaster work, interior painting, and related contracting services. By accessing our website, requesting a quote, or hiring us for a project, you agree to be bound by these Terms. Please read them carefully.

1. Services Provided

MrWalls Drywall & Painting provides professional drywall and painting services to residential and commercial clients in Western Massachusetts. Our services include, but are not limited to:

  • Drywall repair, installation, and finishing
  • Plaster repair, ornamental plaster, and blueboard veneer plaster
  • Interior painting and texturing
  • Popcorn ceiling repair and removal
  • Water damage restoration and ceiling repair
  • Skim coating, knockdown texture, and soundproofing
  • Project-specific services as described in a written estimate or contract

2. Estimates and Contracts

All projects begin with a written estimate that outlines the scope of work, materials, timeline, and total cost. An estimate is not a guarantee that the project will cost the exact quoted amount any significant unforeseen conditions (such as hidden moisture problems, mold, or structural framing issues) may require adjustments. Once the estimate is accepted and a deposit is made, a binding agreement is formed between you and MrWalls Drywall & Painting for the described work. If serious unforeseen framing issues are found you have the right to cancel the remaining work and we will only charge for the portion of the work that has been completed.

3. Access to the Property

To perform our services, we require safe and unobstructed access to the work area. You, the property owner or authorized representative, agree to:

  • Provide access to the property on the scheduled dates.
  • Remove or secure personal belongings in the work area prior to the start of work.
  • Ensure that electrical outlets, water access, and adequate lighting are available where needed.
  • Notify us of any hazards, including known asbestos, lead paint, or structural concerns, prior to commencing work.

If our crew is denied access or the property is not prepared as agreed, additional charges may apply for rescheduling, and the project timeline may be extended.

4. Payment Terms

Deposits: A deposit may be required before work begins to cover materials and scheduling. The deposit amount will be specified in the estimate or contract. Deposits are non-refundable once materials have been purchased or work has commenced, per our Refund Policy.

Final Payment: The remaining balance is due upon completion of the project, unless otherwise specified in the contract. We accept payment via check, cash, and other methods as agreed upon.

Late Payments: Failure to pay the outstanding balance within the agreed-upon timeframe may result in additional charges, and MrWalls Drywall & Painting reserves the right to pursue legal action to collect unpaid amounts.

5. Change Orders

Any changes to the original scope of work, including additional tasks, materials, or modifications, must be agreed upon in writing by both parties. Change orders may result in additional costs and extended timelines. Verbal requests for changes must be documented before work on the change begins.

6. Project Timeline and Delays

We make every effort to complete projects within the estimated timeframe. However, timelines are estimates and may be affected by factors beyond our control, including weather conditions, material shortages, permit delays, or the discovery of unforeseen issues (such as hidden water damage, mold, or structural problems). We will communicate any anticipated delays promptly.

7. Warranty

MrWalls Drywall & Painting provides a warranty on workmanship for all completed projects. The warranty period and coverage will be specified in the contract or estimate upon project completion. This warranty does not cover:

  • Damage caused by water intrusion, excessive humidity, fire,自然灾害, or other external factors after the work is completed.
  • Damage caused by other contractors working in the same area after our work is completed.
  • Normal wear and tear or settling of the building.
  • Issues related to pre-existing conditions not covered in the original scope of work.

8. Limitation of Liability

To the fullest extent permitted by law, MrWalls Drywall & Painting shall not be liable for any indirect, incidental, special, or consequential damages arising from or related to our services. Our total liability shall not exceed the total amount paid by you for the specific service in question.

9. Insurance

MrWalls Drywall & Painting carries general liability insurance to protect against property damage and personal injury that may occur as a result of our work. If a claim arises, we will coordinate with our insurance provider to address the issue. We recommend that property owners maintain their own homeowner's or renter's insurance to cover their property and belongings.

10. Cancellation Policy

You may cancel a scheduled project at any time prior to the start of work. If you cancel:

  • More than 48 hours before the scheduled start date: A full refund of any deposit will be issued, minus any materials already purchased.
  • Less than 48 hours before the scheduled start date: A portion of the deposit may be retained to cover scheduling and material costs.
  • After work has begun: You will be billed for all work completed and materials used up to the point of cancellation. Please see our Refund Policy for additional details.

11. Permits and Compliance

Certain projects may require permits from local municipalities. We assist with permit applications where necessary and perform work in compliance with all applicable building codes and regulations in Western Massachusetts. It is the responsibility of the property owner to verify whether homeowner association (HOA) approvals are needed before work begins.

12. Intellectual Property

All content on the MrWalls Drywall & Painting website, including text, images, logos, and design elements, is the property of MrWalls Drywall & Painting and is protected by copyright and intellectual property laws. You may not reproduce, distribute, or use any content from our website without prior written consent.

We may photograph or record the work site for marketing and portfolio purposes. If you do not want your property photographed, please inform us before work begins.

13. Website Use

By using our website, you agree not to:

  • Use the website for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to our servers, databases, or systems.
  • Use automated tools to scrape, copy, or harvest content from our website.
  • Submit false or misleading information through forms on our website.

14. Governing Law and Dispute Resolution

These Terms and Conditions are governed by the laws of the Commonwealth of Massachusetts. Any disputes arising from or related to our services or these Terms shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached, either party may pursue legal action in the appropriate court in Hampshire County, Massachusetts.

MrWalls Drywall & Painting reserves the right to update or modify these Terms and Conditions at any time without prior notice.
